Abstract

Habebat ius proferendi pomerii’ (Gell., Noctes Atticae, XIII, 14). Theevolution of ius prolationis from the origins to Sulla.
At the end of the Republic the Augur M. Valerius Messalla Rufus ‒ ina page of Libri de auspiciis preserved by the II cent. A.D. antiquarianAulus Gellius ‒ wrote that habebat ius proferendi pomerii qui populumRomanum agro de hostibus capto auxerat (N.A. XIII, 14, 3). In this paperI suggest that this ritual phrase dates back to the IV cent. B.C. andprescribes the increasing both of the ager publicus and of the Romanpopulation registered in the census as a condition for the enlargement ofthe pomerium.
